ORDER
(Order of the Court was made by S.M.Subramaniam J.) The present intra-court appeal has been instituted to assail the writ order dated 18.06.2024 in W.P.No.25801 of 2023.
2. The writ petitioner is the appellant. The relief sought for in the writ petition is to direct the respondents to take appropriate action on the petitioner's representation.
3. The learned counsel appearing for the appellant would submit that the th respondent namely, N.D.R. Warehousing Private Limited has presented two documents for registration, which are undervalued. Since the Sub-Registrar failed to initiate any action, the appellant sent representation. The respondent has not taken any action on the appellant's representation, the writ petition came to be instituted.
4. The learned Special Government Pleader would submit that the Authorities, on scrutiny, found that the actual value adopted by the Presentant of the documents were not in accordance with the provisions of the Indian Stamp Act.
5. However, regarding the allegation raised by the appellant, it was found that the super structure has been undervalued. Consequently, the Panel report was called for and actions are initiated under Section 47-A(3) of the Indian Stamp Act. Therefore, the grievance of the appellant has been addressed.
6. It is needless to state that the action initiated under Section 47-A(3) of the Indian Stamp Act is to be continued and all further appropriate actions are to be initiated in the manner known to law and to be completed as expeditiously as possible
