A.Nos.5119 & 5120 of 2023 in C.S.(Comm.Div.)DR.No.120723 of R.N.MANJULA, J.

These applications have been filed to grant liberty to the applicant to withdraw the suit in C.S.(Comm.Div.)No.120723 of 2023 and file an Admiralty suit afresh within limitation period whenever the 2nd respondent vessel arrive within the jurisdiction of this Court and to return the Court fee paid in the aforesaid suit.

2.Heard the learned counsel for the applicant and perused the materials available on record.

3.On being satisfied with the averments stated in the affidavit filed in support of the applications and also considering the submission made by the learned counsel for the applicant, these applications are allowed.

4.The applicant is permitted to withdraw the suit with liberty to file an Admiralty suit afresh.

5.The Registry is directed to return the Court fee paid in the said suit to the applicant.
