J U D G M E N T

(Judgment was delivered by S.M.Subramaniam J.) The writ order dated 15.12.2023 passed in W.P.No.34513 of 2023 is under challenge in the present writ appeal.

2. The respondent filed a writ petition seeking a direction to the appellants to pass orders on his application dated 03.03.2023 for grant of patta in respect of the respondent's land in S.Nos.92 and 540/2, Reddivalam Village, Nemili Taluk, Ranipet District having an extent of 4500 Sq.ft.

3. The learned Single Judge considered the issues and directed the appellants/Department to issue circular in regard to dispose of the application within a stipulated time and to comply with Court orders. Accordingly, the Department issued a circular, specifying procedures and timelines for disposing of such matters.

4. In the present case, since the appellants have not disposed of the patta application submitted by the respondent within the timeline fixed in the circular, the learned Single Judge directed the Chief Secretary, Government of Tamil Nadu, to initiate disciplinary action against concerned officials. Hence, this writ appeal was filed.

5. The matter was later listed for reporting compliance and by order 19.02.2024, the Writ Court recorded that the order had been complied with.

6. In respect of the patta application submitted by the respondent, the learned Government Advocate would also reiterate that the application submitted by the respondent seeking patta had already been disposed of. Therefore, initiation of disciplinary action against the appellants as directed by the writ court may not be required.

7. Considering the fact that patta application submitted by the respondent had already been disposed of and the direction issued by the Writ Page No.3 of 5

Court has been complied with, the finding that disciplinary action to be initiated by the Chief Secretary in paragraph 7, alone is set aside. Consequently, the Writ Appeal stands allowed in-part. No costs. The connected Miscellaneous Petition is closed.
