This Criminal Original Petition has been filed seeking direction to the first respondent to transfer the investigation in Crime No.18 of 2024, pending on the file of the second respondent to some other investigating agency.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. It is the grievance of the petitioner that the accused had lured him with the promise of securing a job, received more than Rs.20 lakhs and cheated him. Therefore, the petitioner lodged a complaint. However, since no action was taken by the second respondent, the de facto complainant approached the Court below. Thereafter, based on the directions issued by the Court in C.M.P.No.2890 of 2024 dated 11.12.2024, a First Information Report in Crime No.18 of 2024 was registered for the offence under Section 420 IPC. However, thereafter, no further progress has been made in the investigation. Hence, the present petition has been filed seeking transfer of the case from the file of the second respondent to some other agency.
4. In the light of the above submissions, when a query was pointed 2/4
out by this Court to the learned Additional Public Prosecutor, he submitted that after filing of the First Information Report, no further investigation has been conducted. This itself indicates how casually the crime has been treated. Having filed the FIR, when the investigating agency remains a mute spectator without taking any steps, it affects the criminal justice system. Having filed the FIR in the year 2024, with nothing moved even an inch thereafter, this Court is of the view that it is a fit case where the investigation should be handed over to a special team.
5. In view of the above, the first respondent is directed to constitute a special team headed by the Deputy Superintendent of Police and the Investigating Officer shall complete the investigation as expeditiously as possible.
6. With the above directions, this Criminal Original Petition stands disposed of.
