The petitioner is an accused/A1 in Crime No.667 of 2023 registered by the respondent police for the offence punishable under Sections 4(1-A), 4(1)(aaa) r/w 14 of Tamil Nadu Prohibition Act, who had been arrested and remanded to judicial custody on 19.09.2023, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of about 60 litres of Pondicherry Arrack, 72 bottles of Corona Beer and another 216 bottles of beer in a car. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) for the respondent stated that the petitioner along with other accused were found in possession of 60 litres of Pondicherry Arrack, 72 bottles of Corona Beer and another 216 bottles of beer in a car. He further stated that investigation is still under preliminary stage and the seized items have been sent to Forensic Department laboratory for verification. He further stated that there is a proposal to detain the petitioner under Tamil Nadu Act 14 of 1982.

5. In view of these circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
