No.28767 of 2023 and W.M.P No.28356 of 2023 This Writ petition filed under the Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records in the Distraint Order dated 22.09.2023, issued by the 2nd respondent herein with respect to the property of the petitioner at Door No.129/49, 2nd, 3rd and 4th Floors, Diamond Complex, Nethaji Subash Chandra Bose Road with Consumer No.05/057/0457/000 with regard to the exorbitant and retrospective levy of Water
and Sewerage Connection charges of Rs.5,07,797/- and quash the same as arbitrary, illegal and unjustifiable and further direct the respondents not to levy any water consumption charges for the said property as there is no water supply by the respondents..

... Respondents This case came up for settlement before the National Lok Adalat. Petitioner and the respondent are present. The learned counsel appearing for the petitioner Mr. M. Suresh and Mr. M. Vinoth, Standing Counsel, the learned counsel
appearing for the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT Today, on behalf of the petitioner, her son namely Mr. R. Ronak Gugaliya present along with General Power of Attorney to represent in this case. The husband of the petitioner namely S. Rameshkumar is also present. The respondent has also not disputed the Power of Attorney to represent by the son of the petitioner. Power Deed is recorded.
2. The respondent has arrived at a calculation after revising the previous calculation and now they arrived at a calculation of Rs.1,18,823/- (Rupees One Lakh Eighteen Thousand Eight Hundred and Twenty-Three only). The same is accepted by the petitioner.
3. The petitioner seeks time to pay the above said amount of Rs.1,18,823/- (Rupees One Lakh Eighteen Thousand Eight Hundred and Twenty-Three only) on or before 30.06.2025. Otherwise, they have to pay 1% surcharge.
4. With the above said compromise, both parties have agreed to settle the matter. The attested copy of the revised order for a sum of Rs.1,18,823/- (Rupees One Lakh Eighteen Thousand Eight Hundred and Twenty-Three only) is
produced before this Forum and the same may be treated as part and parcel of this Award. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
