ORDER

The above writ petition has been filed seeking a mandamus to the respondent to settle the difference amount of the medical leave salary for 167 days which he is entitled to, as per the G.O.(Ms) No.220, Transport (C1) Department dated 06.08.1999.

2. The petitioner had served in the respondent-Corporation from 07.10.1981 as a steno-typist and had retired on 31.05.2013, on he attaining the superannuation. The petitioner would submit that he had 167 days of medical leave to his credit as on 31.08.1998, and the respondentManagement by computing his last drawn salary, had also encashed his leave salary on 01.01.1998. The petitioner would now draw reference to G.O.(Ms) No.220 Transport (C1) Department dated 06.08.1999, wherein the Government had restructured the pay scale and the employees of the Transport Corporation are entitled to receive the difference amount of medical leave salary as per the revised scale of pay, which would take effect 2/5

from 01.09.1998. Accordingly, the petitioner is entitled to receive the difference in medical leave salary as per the said G.O. In this connection, he had sent a representation on 07.03.2025 to the respondent and the same was not considered to date. Hence, the petitioner is before this Court.

The petitioner would contend that similarly placed employees had approached this Court in W.P.(MD) No.14520 of 2020, W.P.No.29602, 29604, 29606 and 29609 of 2023, W.P.No.2891 of 2025 and W.P.No.2895 of 2025 and had obtained orders of this Court. Hence, he seeks a similar relief may also be extended to him.

4. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent.

Considering the representation of the petitioner dated 07.03.2025 and in the light of the orders passed by this Court for similarly placed persons in W.P.(MD) No.14520 of 2020, W.P.No.29602, 29604, 29606 and 29609 of 2023, W.P.No.2891 of 2025 and W.P.No.2895 of 2025, the same yardstick may also be applied to the case of the petitioner. Accordingly, a 3/5

mandamus is issued to the respondent to consider the representation of the petitioner dated 07.03.2025, and to settle the difference amount of the medical leave salary to the petitioner, if he is entitled to, on or before 28.08.2025, along with interest if any, as per law.

6. With the above direction, the writ petition is disposed of. No costs. Post the matter for reporting compliance on 29.08.2025. 18.08.2025 Index : Yes / No ds To:
