The petitioners who apprehend arrest by the respondent police in respect of the Non-Bailable warrant issued by the learned Judicial Magistrate No.II, Tiruppur, in C.C.No.17 of 2022 on 22.08.2023 for the alleged offences under Sections 120(b), 420 and 35 of IPC, seek anticipatory bail. 2.
When the matter was taken up for hearing today, the learned counsel appearing for the petitioners submitted that due to unavoidable circumstances, the petitioners could not attend the trial and due to their nonappearance, the trial Court has issued non-bailable warrant and the same is pending before the trial Court and the petitioners are ready to furnish sureties and hence, he seeks anticipatory bail to the petitioners. 3.
The learned Government Advocate (Criminal Side) appearing for the respondent police submits that the trial Court has issued non-bailable warrant against the petitioners for their non-appearance and the same is pending in C.C.No.17 of 2022.

Considering the representations made by both sides and considering the fact that the Non Bailable Warrant (NBW) is pending before the trial Court as against the petitioners and the case is pending from the year 2022, it is appropriate to direct the petitioner to appear before the trial Court, by filing a petition to cancel the Non Bailable Warrant (NBW), within a period of 15 days from the date of receipt of a copy of this order and if any such application is filed, the trial Court is directed to consider the said application on the same day on merits and in accordance with law. The trial Court is also directed to dispose the case as early as possible, preferably, within a period of six months from the date of receipt of a copy of this order. 5.
With the above directions, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. 19.10.2024 vkr To 1.The Judicial Magistrate No.II, Tiruppur.
