Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the second respondent to pay Family Pension Gratuity, General Provident Fund, Special Provident Fund and other service benefits of the petitioner's husband to the petitioner with interest at the rate of 9% per annum for which the petitioner lastly made a representation dated 19.11.2015 to the second respondent. ORDER

In this writ petition, prayer has been made for issuance of mandamus directing the second respondent to pay Family Pension Gratuity, General Provident Fund, Special Provident Fund and other service benefits of the petitioner's husband to the

petitioner with interest at the rate of 9% per annum. 2.The case of the petitioner is that due to illness, the petitioner's husband died on 29.03.2015, when he was working as Assistant in the 3rd respondent's office, therefore, she has produced all the relevant certificates and documents as required by respondents 2 and 3 for the early settlement of service benefits of her husband to her. The second respondent has forwarded all such documents and certificates with his recommendations to the fourth respondent for approval and sanction of service benefits of the petitioner's husband to the petitioner. Since the fourth respondent has not taken any action in this regard till date, the petitioner made a representation dated 19.11.2015 to the second respondent and marked a copy to the first respondent requesting to settle her grievance.

3. Learned Government Advocate appearing for the respondents submitted that a direction may be given to the second respondent to consider the said representation.

4. In the light of the above facts, the writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 19.11.2015 and to pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
