PRAYER: This Criminal Revision Case has been filed under Sections 397 and 401 of Cr.P.C against the judgment of the learned IV Additional District & Sessions Judge, Coimbatore in Crl.A.No.30 of 2011, dated 05.12.2015 enhancing the sentence by ordering compensation of Rs.3,50,000/- with interest at a rate of 9% per annum (allowing the appeal preferred by the respondent/complainant in Crl.A.No.37 of 2015) and confirming the conviction by the learned Judicial Magistrate No.1, Pollachi, in C.C.No.350 of 2002 by a judgment dated 20.01.2011, wherein the petitioner was sentenced to undergo one year simple imprisonment and Rs.5,000/- as fine in default to undergo simple imprisonment for two months for an offence under Section 138 Negotiable Instrument Act.

ORDER

Due to the best efforts taken by the Mediation, both the parties have compromised and a memo has been filed to that effect.

2.The judgment passed by the learned IV Additional District & Sessions Judge, Coimbatore, in Crl.A.No.30 of 2011, dated 05.12.2015, by enhancing the conviction and sentence passed in C.C.No.350 of 2002, by the learned Judicial Magistrate No.1, Pollachi, dated 20.01.2011, is hereby set aside since the complainant/respondent herein is agree to withdraw the complaint itself. As per the conditional order passed by the Trial Court, at the time of admission of this Criminal Revision Case, the revision petitioner has paid a sum of Rs.1,00,000/- and Rs.5,000/- as fine amount and hence, the petitioner is hereby directed to withdraw the same.

3.Recording the memo of compromise, this Criminal Revision Case stands allowed.
