2. Heard the learned counsel on either side and perused the materials available on record.

The petitioners are qualified to apply for the post of Motor Vehicle Inspector Grade II as per notification No.3/2018, dated 14.02.2018 and accordingly, they have applied for the said post and also attended the interview. Thereafter, some of the candidates were rejected on the ground that they had worked in unrecognized institutions for their experience. Therefore, they have challenged the said rejection of their candidature and now, the said issue is pending before the Hon'ble Supreme Court in S.L.P.(C).No.7906 of 2024. While being so, the respondents herein issued a notification No.11/2024 dated 13.08.2024, thereby inviting applications for recruitment to the post of Motor Vehicle Inspector Grade II by changing the eligibility criteria. Therefore, the petitioners have filed this writ petition before this Court, with the above prayer.

Now, it is clarified that the earlier notification was issued to fill 113 vacancies for the post of Motor Vehicle Inspector Grade II and as per the present notification, it has been notified to fill 45 vacancies to the post of Motor Vehicle Inspector Grade II, keeping the earlier 113 vacancies in abeyance. These can be filled subject to the result of S.L.P.(C).No.7906 of Page No.3 of 7
2024, pending before the Hon'ble Supreme Court. Therefore, the earlier vacancies notified in the notification dated 14.02.2018 are now kept vacant, and those vacancies are not included in the present notification dated 13.08.2024. Hence, the present recruitment notification has nothing to do with the earlier notification dated 14.02.2018. Furthermore, it is made clear that if the persons who challenged the rejection of their candidature fail before the Hon'ble Supreme Court, the selection process can proceed further as per notification dated 14.02.2018. In view of the interim order passed by this Court on 30.09.2024 in this writ petition, the finalization of selection list has been stalled.

In view of the above, no direction is required as sought in this writ petition, since the respondents are keeping the 113 vacancies in abeyance and have issued the present notification to recruit for the post of Motor Vehicle Inspector Grade II to fill up 45 vacancies. Therefore, the prayer sought by the petitioner in this writ petition cannot be granted.
6. With the above observations, this Writ Petition is dismissed. However, the 2nd respondent is directed to publish the selection list within Page No.4 of 7
a period of two (2) weeks from today i.e. 19.11.2025 and thereafter, the 1st respondent is directed to issue appointment orders to the selected candidates to the post of Motor Vehicle Inspector Grade II. No costs.
