The petitioner herein was arrested on 13.02.2025 for the offence under Section 5(m), 5(1) r/w 6 of the Protection of Children from Sexual Offences Act 2012 and under Section 351(2) of BNS,2023. 1/4

2. According to the petitioner, due to enmity, a false complaint been given against him and he is in prison, since 13.02.2025. Though final report filed, the respondent police produce any witness so far.

3. The learned Government Advocate(Crl.Side) appearing for the respondent police states that the victim is 12 years old child residing in the ground floor of the premises, whereas the petitioner is in the first floor under threat been sexually abusing the girl child and committed penetrative sexual offence, by threatening the victim that he will do away her family. He further submits that the matter is now posted to 26.08.2025 for framing of charge .

4. Considering the fact and the stage of the case, this Criminal Original Petition stands dismissed for the present . 14.08.2025 Vv 2/4
