Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of certiorarified mandamus to call for the records in Na.KA.No.100/2008/A1 dated 30.04.2015 on the file of the respondent and quash the order in respect of 25% increased rent and direct the respondent to fix the rent in accordance with GO.Ms.No.92 dated 03.07.2007. O R D E R

First objection raised by the learned counsel appearing for the respondent when the matter came up for admission on 11.02.2016, is by stating that the petitioner is Government servant and she could not have become a lessee of the shop owned by Town Panchayat. However, today the learned counsel for petitioner is not present and representation is made on his behalf for adjournment. The matter is coming up after nearly one month, and the Court is not inclined to adjourn the matter. If the petitioner is a Government Servant, obviously she cannot be a lessee. Further more, with the object of increasing the revenue for Town Panchayat, the impugned proceedings has been issued. That apart, the impugned proceedings was issued on 30.04.2015, the writ petition has been filed on 08.02.2016 and the delay in approaching the Court has not been explained. https://hcservices.ecourts.gov.in/hcservices/

2. Learned counsel for the respondent would further submit that other similarly placed persons have accepted the increase as they found the increase to be fair and reasonable.

3. For the reasons stated above, this writ petition fails and is accordingly dismissed. No costs. Consequently, connected miscellaneous petition is closed.
