ORDER
By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
2.This Writ Petition has been filed seeking for issuance of a Mandamus, directing the respondents to consider the petitioners' representation dated
11.03.2025 to give scale of pay as per G. O(D) No.792, Health and Family welfare (AB1), Department, dated 05.04.2017 and give all other service and monetary benefits.
3.Heard the learned counsel for the petitioners and the learned Additional Government Pleader appearing for the respondents 1 to 5 and perused the averments available on record.
4.The case of the petitioners is that they were initially appointed as Sanitary worker and Night Watchman respectively, in the Government Primary Health Centre by the 4 th respondent vide G.O.Ms.No.396, dated 23.08.1999. They completed more than 6 years of service and were receiving the consolidated pay of Rs. 1500/- per month. While so, the 4 th respondent issued proceedings dated 22.08.2014, which was communicated to one Palani, stating that the person working under the Primary Health Centre based on the consolidated Pay/daily wages will be absorbed in the special time scale of pay and the same was recommended to the third respondent for approval. Based on
that Government Order, the third respondent issued circular to the respective Deputy Director of Health Services for particulars and salary payment details of RCH Sanitary workers. The Government has issued G.O.(D) No.792, dated 05.04.2017, considering the welfare of the sanitary workers. The grievance of the petitioner is that he is entitled for revised scale of pay as per G. O(D) No.792, Health and Family welfare (AB1), Department, dated 05.04.2017. Therefore, the petitioners gave a representation to the respondents on 11.03.2025 in this regard. Since no action has been taken by the respondents till now, the petitioners are before this Court by way of filing the present Writ Petition.
5. Learned counsel for the petitioners submitted that it would be suffice if this Court issues a direction to the respondents to consider the petitioners' representation and pass orders.
6.Learned Additional Government Pleader appearing for the respondents submitted that the representation of the petitioners will be considered within a
time frame as fixed by this Court.
7.In the light of the above, without going into the merits of the case, this Court directs the respondents 3 & 4 to consider and pass appropriate orders, on the petitioners' representation dated 11.03.2025 on its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order and communicate the same to the petitioners.
8. With the above direction, this Writ Petition stands disposed of. No costs.
