The appeal is against an order dismissing a suit for declaration that the settlement deed executed by the 1st defendant is invalid and for partition of the property. The plaintiff was unsuccessful before the Trial Court.

2.Any sale, pending appeal will be subject to result of the appeal.

3.The learned counsel would also concede that there was no order of injunction pending suit. Hence, we do not see any necessity for grant of injunction.

This Civil Miscellaneous Petition is therefore, dismissed.
