Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 2nd respondent to dispose the appeal filed by the petitioner dated 26.05.2023, 29.08.2023 & 23.07.2025 against the proceedings in Na.Ka.No.A2/414/2023 dated 16.05.2023 and pass appropriate orders thereof on merits and in accordance with law, within a time frame that may be fixed by this Court. 1/5

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The relief sought in this writ petition is to direct the 2nd respondent to dispose of the Appeals dated 26.05.2023, 29.08.2023 & 23.07.2025 preferred by the petitioner as against the Proceedings dated 16.05.2023 bearing Na.Ka.No.A2/414/2023 issued by 3rd respondent, on merits and in accordance with law, within a time frame that may be fixed by this Court.

3. The learned Special Government Pleader appearing for the respondents submitted that 2nd respondent would dispose of the petitioner's Appeals dated 26.05.2023, 29.08.2023 & 23.07.2025, within a time frame to be fixed by this Court.

4. The above submission made by the learned Special Government Pleader for the respondents has been fairly conceded by the learned counsel for the petitioner.

In view thereof, this Court, without expressing any opinion on the merits of the case, directs the 2nd respondent to dispose of the petitioner's Appeals dated 26.05.2023, 29.08.2023 & 23.07.2025 and pass appropriate orders, on merits and in accordance with law, after issuing notice and affording a reasonable opportunity of hearing to the petitioner and all other interested parties including rival claimants, if any, within a period of sixteen weeks from the date of uploading of the web copy of this order without waiting for the receipt of a certified copy of this order.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
