This writ petition has been filed seeking a direction to the first respondent to receive and pass orders on the application dated 01.04.2022, along with records to the petitioner's Omni Bus bearing Registration No.TN 28 AL 8010 to ply on all roads in the State of Tamil Nadu by renewing the permit considering the petitioner's representation dated 10.09.2022, without demanding tax.
2. Today, when this matter was taken up for hearing, the learned Special Government Pleader appearing for the respondents would submit that already the application filed by the petitioner for renewal was considered and as the tax has not been paid with penalty his application was returned.
3. This Court is of the view that whether to renew or not has to be decided by the authorities and therefore the order has to be passed on the application. Such view of the matter, the petitioner is directed to re-present the application within a week from the date of receipt of a copy of this order and thereafter on receipt of the same, the respondents shall consider the same 2/4
on merits and pass orders whether to renew or not as per law after affording an opportunity of hearing to the petitioner within a period of two months thereafter. With the above direction, this writ petition is disposed of. No costs.
