This petition has been filed to condone the delay of 65 days in filing the above appeal.

2. Heard the learned counsel appearing for both sides and perused the materials available on record.

3. The learned counsel for the respondents submitted that the reason for the delay has not been properly explained by the petitioner.

4. However, on being satisfied with the averments stated in the affidavit filed in support of the petition and also considering the submissions made by the learned counsel for the petitioner, the delay is condoned.

Accordingly, this petition is ordered.

4. Registry is directed to number appeal, if it is otherwise in order and post for admission on 17.09.2021.
