ORDER

This Criminal Miscellaneous Petition has been filed to suspend the sentence imposed on the petitioner in C.C.No.116 of 2019 by the Hon'ble Principal Special Court for Exclusive Trial of Cases Under NDPS Act, Chennai by its judgment dated 29.05.2025 and release the petitioner on bail pending the Criminal Appeal.

The petitioner, who is arrayed as A4 in C.C.No.116 of 2019 by the Hon'ble Principal Special Court for Exclusive Trial of Cases Under NDPS Act, Chennai, was convicted and sentenced vide judgment dated 29.05.2025, as follows:

Rank of the accused Conviction under Section Sentence awarded A4 8(c) r/w. 29 To undergo rigorous imprisonment for 10 years and to pay Rs.1,00,000/- as fine, in default to undergo six months simple imprisonment To undergo 10 years Rigorous imprisonment with a fine of Rs.1,00,000/-, in default, to undergo six simple imprisonment.

Heard the learned counsel for the petitioner and the learned Special Public Prosecutor for the respondent. 4.

This Court finds that no prima facie case has been made out for suspension of the sentence since the Trial Court has gone through the evidence in its entirety and also finds that the petitioner had committed very serious and heinous offence.

In the result, the petition for suspension of sentence is dismissed.
