Prayer: Second Appeal filed under Section 100 of Civil Procedure Code, against the Judgement and decree of the court of the III Additional Subordinate Judge, Coimbatore dated 31.10.2008 made in O.S.No.110 of 2007 confirming the Judgement and decree of the court of the V Additional District and Sessions Court, Coimbatore dated 09.06.2014 made in A.S.No.65 of 2010. Decree: This Second Appeal coming on for hearing on this day upon perusing the Grounds of Appeal, the Judgment and Decree of the Lower Appellate Court and the Court of first instance and the material papers in the case and upon hearing the arguments of Mr.A.Ramasamy, Advocate for the Appellant and none appeared either in person or by Advocate for the Respondent, this Court doth order and decree as follows:

1. That the Judgement and decree of the court of the III Additional Subordinate Judge, Coimbatore dated 31.10.2008 made in O.S.No.110 of 2007 confirming the judgement and decree of the court of the V Additional District and Sessions Judge, Coimbatore dated 09.06.2014 made in A.S.No.65 of 2010 be and hereby is confirmed and this Second Appeal is dismissed; and

2. That the Appellant do pay a sum of Rs. 10/-(Rupees Ten Only) towards costs to the Respondent.
