ORDER

The learned Special Government Pleader has placed before this Court the Proceedings, dated 28.02.2024 of the respondent, by which the order which is the subject matter of this Contempt Petition has been 1/4

complied with.

2. In the Proceedings of the respondent, dated 28.02.2024, the Proceedings of the 1st respondent in the writ petition (Directorate of Collegiate Education), dated 21.07.2022 in Na.Ka. No.41529/G2/2017 has been considered and the respondent has also given reasons as to why the benefit of those Proceedings was not made applicable to the petitioner herein.

3. However, the learned counsel for the petitioner would submit that no proper reasons have been given as to why the petitioner has not been given the benefit of the Proceedings of the Directorate of Collegiate Education, dated 21.07.2022 in Na.Ka. No.41529/G2/2017.

4. The scope of the contempt petition is very limited. This Court will have to see only as to whether the order which is the subject matter of the contempt petition has been obeyed or not. This Court after perusing the Proceedings of the respondent, dated 28.02.2024 is of the prima facie view that the order, which is the subject matter of the contempt petition has been obeyed, and therefore necessarily, the Contempt Petition has to be closed. However, liberty will have to be granted to the petitioner to challenge the Proceedings of the respondent, dated 28.02.2024 as the petitioner categorically contends that in the said 2/4

order, the respondent has not given sufficient reasons for not considering the Proceedings of the Directorate of Collegiate Education, dated 21.07.2022 in Na.Ka. No.41529/G2/2017 in respect of another similarly placed College.

5. For the foregoing reasons, this Contempt Petition is closed. However, liberty is granted to the petitioner to challenge the Proceedings of the respondent, dated 28.02.2024, if so aggrieved in the manner known to the petitioner under law.
