With the consent of both sides, the Writ Petition is taken up for final disposal.
2.The case of the petitioner is that her father S.Muruganandam joined the Tamil Nadu Government Service and he retired from service on 30.06.1983 on attaining the age of superannuation. Thereafter, he was receiving pension. After his demise i.e. on 23.07.1990, the petitioner's mother S.Rathinanthavalli was sanctioned the family pension and she was also died on 16.08.1996.
3.The petitioner would state that her husband S.T.Rajaguru died on 06.10.2011 and therefore as per G.O. Ms. No.325, Finance (Pension) Department dated 28.11.2011, G.O. Ms. No.165 Finance (Pension) Department dated 21.05.2012 and the G.O. Ms. No.29 Finance (Pension) Department dated 31.01.2013, the petitioner is entitled for pension being a https://hcservices.ecourts.gov.in/hcservices/
widow daughter. Since the benefits were not given to the petitioner, she made a representation dated 06.02.2014. Since no order has been passed, the petitioner filed the present writ petition.
4.Heard the submissions of Mr.I.Bobby Portia, learned counsel appearing for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader, who accepts notice on behalf of the respondents.
5.This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the third respondent to consider the representation of the petitioner dated 06.02.2014 and to pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
