The petitioner herein, a close associate of one Kitcha @ Krishnamoorthy, had gone to the house of the defacto complainant with an illegal intention and 1/4

attempted to force her to have sexual intercourse with him. Hence, a complaint was registered by the respondent police on 1907.2025 for offences under Sections 296(b), 115(2), 332(C), 75(2), 79 & 351(3) of BNS, 2023 read with Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.380 of 2025. 2.

The complaint indicates that the defacto complainant's first husband died and the 1st accused is the brother of her first husband. The defacto complainant has since married another man, namely Muthu and is living with her children. While so, the 1st accused along with this petitioner went to the house of the defacto complainant on 19.07.2025 at about 6.00 p.m., and attacked the husband of the defacto complainant and tried to misbehave with the defacto complainant.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that both the petitioner and his associate, A1, are notorious persons in the locality, each having more than eight cases registered against them and they had gone to the defacto complainant's house with bad intention of driving out her husband and to having sexual pleasure with her. 2/4

Considering the nature of the crime and the stage of investigation, this Court is not inclined to grant bail. Hence, the Criminal Original Petition stands dismissed.
