A.No.9501 of 2019 in C.S.No.283 of 2019 DR.G.JAYACHANDRAN,J.

The first defendant herein has filed a written statement on 26.08.2019. Since the first defendant received the suit summon on 24.06.2019 and failed to file the written statement within 30 days, the written statement was returned by the Registry to file an application to condone the delay in filing the written statement. Accordingly, the first defendant has taken out an application in A.No.9501 of 2019 to condone the delay of 33 days in filing the written statement.

2. As per the amended Rule under the Commercial Courts Act, written statement has to be filed within 30 days from the date of receipt of the suit summon and further period of 90 days is permissible if sufficient causes stated by the defendant.

3.The learned counsel appearing for the 1st defendant states that to get the document in support of the statement the delay has occurred.

4.Considering the above said reason, the delay of 33 days in filing the written statement is allowed on payment of Rs.2,500/- as costs payable to the plaintiff on or before 13.01.2020. 02.01.2020 ari 1/1 http://www.judis.nic.in
