The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 20(b)(ii) B, 8(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, Section 77 of Juvenile Justice (Care and Protection of Children) Act, 2015 and Section 25(1-B) (1) Arms Act, 1959 in Crime No.125 of 2023, seeks anticipatory bail.

2.It is the case of the petitioner that the petitioner was not involved in the aforementioned crime. It is also contended that the 2nd and 4th accused had been granted bail by the learned III Additional District Judge, Puducherry in Crl.M.P.No.3543 and 3544 of 2023 on 19.09.2023.

3.The case of the respondent is that the petitioner had indulged in smuggling of Ganja and they had seized 3.280 Kgs of Ganja, country made gun, motorbike and mobile phones and it is their contention that the accused persons were actively involved in smuggling of Ganja and selling the same to the school and college students.
