The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 120B, 147, 148, 294(b), 427, 506(ii) and 302 of IPC in Crime No.297 of 2022 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution as per the de-facto complainant Lalitha is that the petitioner along with other accused assaulted her husband indiscriminately with iron rods and due to which, her husband succumbed to injuries. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he is no way connected with the alleged offence. He would further submit that during the alleged occurrence the petitioner was working in a brickyard and he was not present in the scene of occurrence. 4. The learned Additional Public Prosecutor appearing for the respondent would submit that already this Court dismissed the petitioner's earlier anticipatory bail petition in Crl.O.P.No.25384 of 2022 dated 19.10.2022 considering the fact that there are specific overt act against the petitioner. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the fact that there are specific overt act against the petitioner and also considering that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
