Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, direct the 1st and 2nd respondents to consider the Petitioners representation dated 04.03.2024, consequently to cancel the Trust Registration name Siradi Saibaba Siddhar Peedam Arakattalai vide reg. O R D E R
The Writ Petition is filed for the following reliefs:- "direct the 1st and 2nd respondents to consider the Petitioner's representation dated 04.03.2024, consequently to cancel the Trust Registration name Siradi Saibaba Siddhar Peedam Arakattalai vide reg.No. 411 of 2023 dated 07.06.2023."
2. The petitioner who claims to be a member of the 5th respondent association would submit that the petitioner and the local area auto drivers had started an association called "Sri Saibaba Auto Stand" and had put up 2/6
a temple for Sai Baba adjacent to the auto stand. He would submit that some persons had started illegally collecting contributions from the devotees and had been misusing the funds.
3. While so, on 07.06.2023, the members who, according to the petitioner, had been manipulating the funds and illegally collecting contributions formed another association in the name of 'Shirdi Saibaba Siddhar Peedam Arakattalai' without the knowledge of the other members.
4. On 04.03.2024 and 05.09.2024, the petitioner had submitted representations to respondents 1 to 4, requesting legal action against some of the members of the Trust and asking the authorities to cancel the Trust Registration. However, no action has been taken to date. Therefore, the petitioner is before this Court.
5. Heard the learned counsels on either side.
6. The petitioner is in no way connected with the 5th Respondent Trust and the allegations that have been made are also rather vague. Even according to the petitioner it is the Association called the "Sri Saibaba Auto 3/6
Stand" that has put up the temple. Further, he claims to be a member of the 5th respondent Association but has filed the Writ Petition in the name of the petitioner Association. Further, none of the other members of the association have come forward with any complaint. Therefore, it appears that this Writ Petition is an attempt to resolve a private dispute, it is not maintainable.
7. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. 19.12.2024 (shr) Index : Yes/No Speaking Order: Yes/No To 4/6
