O R D E R

This Criminal Original Petition has been filed to enlarge the petitioners on anticipatory bail in the event of arrest in Crime No.470 of 2021 on the file of the Inspector of Police, Ambattur Police Station,

2. The case of the prosecution is that the petitioners and defacto complainant are close relatives. It is alleged that the first petitioner has borrowed a sum of Rs.49,000/- as hand loan and failed to repay the same and she has stolen some valuables from the house of the defacto complainant. Hence, complaint was registered.

3. Apprehending arrest at the hands of the respondent Police, petitioners have filed Crl.O.P.No.13416 of 2021. Vide, order dated 3/8/2021, this Court had allowed the petition and the petitioners were ordered to be released on bail in the event of arrest. As per the order of this Court, the petitioners could not get solvency from the Village Administrative Officer. Therefore, they could not execute the sureties before the Judicial Page No:2/4

Magistrate Court - I, Poonamallee, within the time fixed by this Court. Hence, the petitioners have come up with the present petition for fresh anticipatory bail.

4. The learned Government Advocate (Criminal Side) submitted that charge sheet has been filed before the learned Judicial Magistrate No.II, Poonamallee and the same was taken on file in C.C.No.384 of 2024 and the case has been posted for appearance of the accused.

5. Since there is no apprehension of arrest, this Court is of the view that there is no need to grant anticipatory bail. However, liberty is granted to the petitioners to work out their remedy in the manner known to law.

6. With the above direction, this Criminal Original Petition is disposed of.
