This petition has been filed seeking to condone the delay of 996 days in filing the civil miscellaneous appeal.

Mr.C.R.Sureshkumar, learned counsel, who takes notice for the respondent, would submit that he has no objection to this petition being allowed. However, he would submit that interest for the delay period may not be granted to the petitioner.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this civil miscellaneous petition is ordered and consequently, the delay of 996 days in filing the appeal is condoned, subject to the condition that the claimant/petitioner will not be entitled to interest for the delay period i.e. for 996 days, in the appeal.
