Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, to call for the records of the First Respondent with No.5/7/3/4/RCS/Dairy/2023/142 dated 19.09.2023 and to quash the same and consequently to direct the First Respondent to permit the elected Board of Directors to continue in office till the end of the term of office namely 31.01.2024 or to conduct Elections as per Scheduled notified by the Respondents.

Heard Mr. V.Ajaykumar, Learned Counsel for the Petitioner and 1/3

Mr. V.Vasanthakumar, Learned Additional Government Pleader, who takes notice for the First Respondent and perused the materials placed on record, apart from the pleadings of the parties.

The claim of the Petitioner in the Writ Petition is that he is entitled to continue in office till the expiry of three years from 01.02.2021 when he was elected to the Board of Directors of Soriankuppam Co-operative Milk Producers Union. However, as the Petitioner has not produced relevant documents to substantiate the same, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to file a fresh Writ Petition with all relevant documents and he has made an endorsement to that effect in the court record.

In fine, the Writ Petition is dismissed as withdrawn granting such liberty. Consequently, connected Miscellaneous Petition is closed. No costs. 05.10.2023 Maya NCS: Yes/No Index: Yes/No Note: Issue order copy by 31.10.2023.
