The petitioner herein seeks quash of the private complaint under Section 138 of Negotiable Instruments Act, on the ground that the subject cheque was given as a security for the loan availed, but even after clearing the loan, the cheque was not returned back and misused by the complainant.

On perusing the record and the reply to the statutory notice, this Court finds that the loan availed by the petitioner after inducing mortgage deed and promissory note duly discharged, therefore, this Criminal Original Petition to quash the private complaint instituted against this petitioner for issuance of cheque to discharge the liability is dismissed as devoid of merit. Consequently, the connected Criminal Miscellaneous Petitions are closed.
