ORDER

The present Application has been filed to grant leave to the schedule D and E properties within the jurisdiction of this Court.

2. Heard the learned counsel for the applicant.

3. The proposed suit had been filed seeking for a preliminary decree of partition of the suit Schedule (A) to (F) of which schedule (A) to (C) are within the jurisdiction of this court. The properties in schedule (D) and (E) are situated outside the jurisdiction of this Court. As the suit is for a partition this Court finds no impediment in granting the relief as prayed for by the applicant and

also to sue the defendants in respect of the schedule (D) and (E) properties.

4. For the aforesaid reasons, the present application is ordered as prayed for.
