This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner wherein the petitioner has sought for payment of arrears of some monetary benefits.

Heard Mr.S.Vijayakumar, learned counsel for the petitioner and Mr.P.Balathandayutham, learned Special Government Pleader for respondents 1 to 5.

The case of the petitioner is that he was appointed as a Over Head Pump Operator in the year 2009 at Therkunam Village Panchayat on a monthly salary. After some time, he was not paid the salary for the period between May 2011 to January 2012. A representation was made in this regard and since the same was not considered, the petitioner filed WP No.32596 of 2019 before this Court. This Court disposed of the writ petition by an order dated 21.11.2019 to consider the representation.

Pursuant to the above order, the 3rd respondent through proceedings dated 30.05.2020 sanctioned arrears of salary along with interest to the tune of Rs.62,496/-. The petitioner was also informed that those who have joined after 10.05.2000 will be paid in the scale of pay fixed by the 7th Pay commission for the remaining days of work also. The petitioner was not extended with this relief. In view of the same, the petitioner made a detailed representation dated 3/6

20.05.2024 to the respondents and on receipt of the same, the 3rd respondent directed the petitioner to appear for an enquiry through letter dated 28.05.2024. No enquiry was conducted and in the meantime, the 2nd respondent through letter dated 30.05.2024 forwarded the request made by the petitioner to the 3rd respondent for taking necessary steps and for paying the monthly salary as per the 7th Pay Commission. The 1st respondent also made a communication dated 03.06.2024 to the respondents 2 and 3 in this regard. The grievance of the petitioner is that till date the same has not been acted upon and as a result, the present writ petition has been filed before this Court. 5.

Taking into consideration the facts and circumstances of the case and the various communications that have been placed before this Court, there shall be a direction to respondents 3 and 5 to deal with the representation made by the petitioner on 20.05.2024 and take a decision within a period of six weeks from the date of receipt of a copy of this order. 6.

The petitioner is directed to make a fresh representation to respondents 3 and 5 along with all the relevant documents and also a copy of 4/6

this order.
