When the matter is taken up today for hearing, the de-facto complainant is present before this Court.
2. Mr.P.Krishnan, the learned Counsel appearing for the de-facto complainant, who is the mother of the victim, submitted that earlier there was a relationship between the petitioner and the victim and they belong to two different communities. He also submitted that later the petitioner has left the victim and married some other woman, thereby, the victim was very much vexed and on account of the instructions given by the de-facto complainant, she has given an exaggerated complaint against the petitioner. He also stated that the de-facto complainant has expressed her remorse and filed an affidavit stating that a false complaint has been given as against the petitioner.
3. The learned Government Advocate (Crl.Side) submitted that based on the complaint given by the de-facto complainant, the case was registered and the statement of the de-facto complainant was also reiterated by the victim before the https://www.mhc.tn.gov.in/judis
learned Magistrate, while recording statement under Section 164 Cr.P.C, however subsequently, after few days, the victim and the de-facto complainant appeared before the respondent Police and given statements that an exaggerated complaint has been given against the petitioner. He further submitted that the investigation is going on.
4. The Affidavit is not available before this Court today. Thereby, list the matter on 18.11.2022.
