Respondents Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the respondents to pay the selection grade scale of pay of the post of P.G.Assistant (Tamil) from 03.07.2009, the date of promotion in the scale of Rs.15600-39100-57 till the date of retirement and consequently revise the pensionary benefits on that basis.

O R D E R

The petitioner, S.Kuppu, joined the service on 17.06.1978 as B.T. Tamil Assistant and he was promoted to the post of P.G.Assistant (Tamil Teacher) on 03.07.2009.

2.The grievance of the petitioner is that as he had served for more than 30 years in the post of B.T. Tamil Assistant and was getting the special scale of pay in the said post on completion of 30 years, he is entitled to be fixed on the basis of the Selection Grade Scale of pay for the post of P.G. Assistant, as per G.O. Ms. No.38, School Education Department https://hcservices.ecourts.gov.in/hcservices/

dated 05.03.2001. Therefore, he made several representations to the respondents. But he was not paid the selection grade scale of pay. Hence, the present writ petition.

3.Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents. 4.Considering the limited relief sought for in the writ petition and without going into the merits of the matter, the second respondent is directed to pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
