ORDER

The present application has been filed to appoint an Independent Valuer for ascertaining the present market values for the Schedule Properties A, B, C and E mentioned in the Judge's Summons and to file a report.

2. The parties to the suit have entered into an understanding to purchase the respective shares of each other. However, for the purpose of valuing the property, they jointly seek this Court to appoint an independent Valuer for ascertaining the market value of the suit Schedule A, B, C and E properties, so as to enable them to pay the respective shares to the other party.

3. In view of the admitted position, this Court appoints Mr.Er.G.Chellaiah Sarathy, Consulting Civil Engineer, residing at New No.6, Old No.2, Jayalakshmipuram 4th Street, Nungambakkam, Chennai - 600 034 as a Valuer to ascertain the present market value of the Judges summons mentioned Scheduled properties.

4. The respective parties shall bear the expenses claimed by the Valuer in equal proportions.

5. In fine, the application in A.No.4156 of 2025 in C.S.No.177 of 2023 is ordered as prayed for. However, there shall be no order as to costs. 25-08-2025 kak Note: Registry is directed to issue warrant by 10.10.2025

(The 3rd Defendant is beng represented by the 2nd defendant (amended as per order dt. 27.03.2024 in CS.No.177/2023)
