Mr.K.Premkumar COMMON ORDER (Order of the Court was made by S.M.Subramaniam J.) The writ orders dated 25.03.2024 in W.P.No.287 of 2024 and W.P.No.284 of 2024 is under challenge in the present intra court appeals.
2. After adjudication, this Court formed an opinion that there is no infirmity in respect of the findings made by the writ Court. However, the compound interest at the rate of 18% per annum alone is the objection raised by the State since the compensation amount has not been seriously disputed. Therefore, this Court has suggested the parties to negotiate the issue regarding payment of interest. After negotiation, the erstwhile land owners/respondents
agreed to receive 12% interest per annum by waiving the right of 18% as ordered by the writ court in the impugned order passed in W.P.No.287 of 2024.
3. Mr.K.Premkumar, learned counsel appearing on behalf of the first respondent would submit that the first respondent has already received the interest amount at the rate of 12% per annum based on the negotiation with the authorities and the grievances of the first respondent are redressed.
4. Regarding the variations in the calculations, the first respondent is at liberty to approach the competent authorities in the manner known to law. In view of the agreement between the parties to settle 12% interest per annum instead of 18% per annum as ordered by the writ court in the impugned order, no further consideration on merits needs to be undertaken.
5. Accordingly the writ orders impugned stands modified to the extent of interest of 18% per annum as 12% per annum and all further findings in the writ orders stands confirmed.
