Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd respondent to consider the petitioner representation dated 05.02.2024 and consequently direct the 3rd respondent to cancel the patta No.608 stands in the names of 5th respondent and issue fresh patta in the name of petitioner. The petitioner herein seeks a direction to the third respondent to consider his representation dated 05.02.2024 seeking cancellation of the patta issued in favour of the fifth respondent and others in respect of 0.64 cents of the land situated in S.No.342/10A, Nellikuppam Village, Chengalpattu District.
2. According to the petitioner, his father Adhi Kesavalu Naidu purchased 0.64 cents out of total extent 1 acre 4 cents in S.No.342/10A under a registered sale deed dated 20.07.1939. However, the official respondents 2/5
issued patta in favour of number of persons including the fifth respondent for the above mentioned property. Therefore, the petitioner submitted a representation on 05.02.2024 before the third respondent seeking cancellation of the patta issued in favour of the private parties and issuance of patta in his name and the same has not been considered. Hence, the petitioner is before this Court.
3. Mr.Mr.A.Selvendran, learned Special Government Pleader, who takes notice for the respondents 1 to 4 would submit that the representation of the petitioner will be considered, on its own merits, within a time frame fixed by this Court.
4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 05.02.2024 and pass final order, on its own merits, within a period of 12 weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner, fifth respondent and other interested parties. 3/5
5. With the above direction, this Writ Petition is disposed of. No costs.
