Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct respondent to dispose of the petitioner's representation dated 13.12.2018 granting 15 days permission to go Abroad (Malaysia, Singapore and Dubai) with regard to the higher studies of petitioner's son within stipulated time. O R D E R
The prayer sought for in this Writ Petition is to direct respondent to dispose of the petitioner's representation dated 13.12.2018 granting 15 days permission to go Abroad (Malaysia,
Singapore and Dubai) with regard to the higher studies of petitioner's son within stipulated time.
2. It is the case of the petitioner that he had joined the service as Sub-Inspector of Police in the year 1996 and promoted as Inspector of Police. While he was working in T-4 Maduravoyal Police Station, on a false allegation complaint was preferred by one V.Gnanasekaran that the petitioner demanded Rs.50,000/-, illegal gratifications for which case has been registered in Crime No.7 of 2007 for the offences punishable under Section 7 of Prevention of Corruptiion Act, 1988 and arrayed the petitioner as A-1 by the Inspector of Police Vigilance and AntiCorruption City Special Unit - III. Subsequently, he was acquitted from charges by order of the Special Judge and Chief Magistrate, Thiruvalur dated 21.03.2016. On 23.04.2018, a charge memo was issued to the petitioner about institution of departmental proceedings. In the meanwhile, the petitioner made representations to the respondents to permit him to go abroad for enquiring about his son's studies. However, till date the representations were not considered. Therefore, the Writ Petition has been filed.
3. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the 3rd respondent to consider the representation dated 31.07.2019 in accordance with law.
5. Considering the limited request made by the learned counsel for the petitioner, this Court hereby directs the 3rd respondent to consider and dispose of the representation dated 31.07.2019, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
4. The Writ Petition is disposed of with the above direction. No costs.
