No.715/2001 dated 27.6.2001 registered in the third respondent office in respect of property to an extent of 29 cents comprised in survey No. 272/1 situated at Kunnam Kaspa and Village, Veppur Sub-Registration District, Ariyalur District based on the petitioner's representation dated 24.8.2024.

ORDER

The petitioner seeks a direction to the second respondent to consider his representation dated 24.8.2024 to conduct an inquiry and to cancel the fraudulent sale deed dated 27.6.2001 registered on the file of the third respondent in respect of the property to an extent of 29 cents comprised in survey No.272/1 at Kunnam Kaspa and Village, Veppur Sub-Registration District, Ariyalur District.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader accepting notice for respondents 1 to 3.

3. In the light of the judgment of a Division Bench of this Court in the case of M.Kathirvel Vs. Inspector General of Registration, Department of Registration and Others [reported in 2024 (4) CTC 769], the prayer sought for cannot be granted, as it has been 2/4

held by the Division Bench that the Registering Authority has no power to cancel the document unilaterally.
