The petitioner was granted suspension of sentence and appeal by this Court by order dated 01.08.2024 with certain conditions. One of the conditions was that the petitioner to appear before the respondent Police on every Monday at 10.30 a.m. before the respondent.

2. The learned counsel appearing for the petitioner submits that the petitioner had sustained injury on 04.102024, he is also a sugar patient and taking treatment hence, seeks modification.

3. The learned Additional Public Prosecutor submitted that the petitioner along with three others have involved in transportation of 303.25 kilograms of Ganja in a Toyota Fortuner car who was apprehended near Karanodai Toll Plaza on 20.09.2019. All the persons have conspired together and committed the offence. The prime accused is from Madurai, Uthamapalayam and this petitioner is from Chennai. All the accused have joined together and transporting Ganja and caught by the Police red handed. https://www.mhc.tn.gov.in/judis

4. This Court granted bail on the ground that the petitioner has been in prison for more than five years. The apprehension of the respondent is that if the petitioner is granted any relaxation of the condition, he would abscond and he will not be available for the appeal. The learned Additional Public Prosecutor requested that he may be directed to appear before the respondent Police in alternative Mondays.

5. In view of the same, the condition imposed is modified and the petitioner is directed to appear before the respondent Police on alternative Mondays at 10.30 a.m.
