The petitioner/A2 seeks bail in Crime No.256 of 2023 registered by the respondent police for the offences punishable under Sections 8(C), 22(C), 25 & 29(1) of NDPS Act. He had been arrested and remanded to judicial custody on 31.05.2023.
2. It is the case of the prosecution that on a complaint lodged by the Rapido driver, the respondent had gone over to the residence of the present petitioner herein and had conducted a search and recovered 80 Pyeevon Spas Plus tablets. On the confession of A2 and A3, A1 had been secured. Totally 1520 tablets had been seized.
3. The learned counsel for the petitioner states that there is no weight given for the said tablets and that therefore, it is not of a commercial quantity.
4. It is also stated that the total number of tablets seized had also not mentioned in the FIR. However, it is seen that the said tablets are under Schedule 2, 3, 8(z)(h). It is a controlled substance and mixed with Psychotropic substance, it becomes commercial quantity. https://www.mhc.tn.gov.in/judis

5. It is stated that the weight of 1520 tablets could be about 250 grams, which is a commercial quantity.
6. In view of the fact that investigation has not yet been completed and the source of suppy also will have to be determined, at this stage, I am not inclined to grant bail to the petitioner.
