This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debts which are actually the amounts in the savings bank account and in the fixed deposit in the name of the father of the petitioners, Mr.S.Muthiah, who died intestate on 20.04.2019. The mother of the petitioners had pre-deceased their father.

2.After following due procedure, the petitioners were directed to tender evidence. Accordingly, the 2nd petitioner examined herself as PW-1. The death certificate of the mother of the petitioners was marked as Ex.P1 and the death certificate of their father was marked as Ex.P2. The legal heirship certificate of their father was marked as Ex.P3. The document relating to the amount lying in the ICICI savings bank account was marked as Ex.P4. https://www.mhc.tn.gov.in/judis

smv 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of both petitioners in accordance with the rules.
