The petitioners/A1, A2, who were arrested and remanded to judicial custody on 19.09.2023 for the offences punishable under Section 306 IPC in Crime No.161 of 2023 on the file of the respondent police, seeks bail. 2.Originally, the case was registered under Section 174 Cr.P.C., and subsequently, altered to Section 306 IPC.

3.The case of the prosecution is that A1 had borrowed a sum of Rs.2,00,000/- from the deceased and when the deceased sought return of the money, the accused herein had threatened him with dire consequences, which lead the deceased to commit suicide. Hence the case was registered against the petitioners.

4.The learned counsel for the petitioners submitted that the petitioners are innocent persons and no way connected with the alleged offence. Hence, he sought for grant of bail to the petitioners.

5.It is stated on the side of the respondent that the 3rd accused is still absconding. If the 3rd accused is absconding, the investigation can never be completed, can never even begin.
