JUDGEMENT Today, when the matter taken up for hearing, the learned counsel for Appellant appeared and submitted stating that as per instructions of appellant, he filed a withdrawal memo on behalf of appellant and seeks permission of this court to withdraw the above Appeal Suit under the scope of liberty to file fresh suit under new cause of action or any appeal or cross objection as they remain unaffected and he has also made endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel appearing for the Appellant, this Appeal Suit is dismissed as withdrawn. Liberty is not granted. No costs.
