J U D G M E N T
(Judgment of the Court was delivered by S.M.SUBRAMANIAM, J.) Writ order dated 25.08.2022 in W.P.No.34019 of 2014 is under challenge in present intra-Court appeal.
2. Admittedly, mother of appellant died due to electrocution. Writ Petition has been filed seeking compensation. Under Board Standing Order, Rs.2 Lakhs compensation is fixed for fatal accident.
3. Learned counsel for appellant would submit that in other cases a sum of Rs.5 lakhs was granted. However, respondents in their counter has stated that Board Standing Order No.6 dated 16.10.2019 awarding Rs.5 Lakhs as compensation was implemented with prospective effect from 29.07.2019. The electrocution occurred in the year 2014. During relevant point of time admissible compensation as fixed under Board Standing Order was a sum of Rs.2 Lakhs. Writ court has granted said compensation of Rs.2 Lakhs and 2/5
further granted liberty to appellant to approach competent civil Court seeking further compensation by establishing negligence, lapse etc., Writ Court in exercise of power of judicial review cannot determine compensation in such cases where adjudication is required. Fixed compensation as per Board Standing Order is directed to be paid and that being the factum, there is no infirmity, as such, in directions issued by writ Court to grant Rs.2 Lakhs to victim.
4. In view of above facts, Writ Appeal stands dismissed. In the event of filing any civil suit, period of time spent before High Court in Writ Petition and Writ Appeal is to be excluded and suit is to be decided on merits. No costs. (S.M.S., J.)
