Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus to direct the respondents 1, 2 and 3 to correct the Date of Birth by adding 14.08.1997 in the place of 14.05.1997 in the petitioner's Secondary School Leaving Certificate (X Standard) issued in April 2012 and in his Higher Secondary Course Certificate (XII Standard) issued in March 2014 and direct the 8th respondent to correct the Date of Birth in the petitioner's Transfer Certificate issued on 22.09.2017 by adding 14.08.1997 in the place of 14.05.1997 and consequently direct the 1st, 2nd, 3rd and 8th respondents to issue corrected Certificates by considering the petitioner representation dated 23.07.2025 within a period to be fixed by this Court. The present writ petition has been filed with a prayer for mandamus to direct the respondents 1, 2 and 3 to correct the Date of Birth in the petitioner's Secondary School Leaving Certificate (X Standard) and in his Higher Secondary Course Certificate (XII Standard) and also direct the 8th respondent to correct the Date of Birth in the petitioner's Transfer Certificate and consequently direct the 1st, 2nd, 3rd and 8th respondents to issue corrected Certificates by considering the petitioner's representation dated 23.07.2025 within a stipulated time.

The learned counsel for the petitioner submits that the petitioner's actual date of birth is 14th August 1997, whereas in the Transfer Certificate and the Mark sheet it has been referred as 14th May 1997. In order to correct the date of birth, the petitioner has submitted a representation to the respondents on 23.07.2025, and such representation is still pending for consideration.

3. At this juncture, the learned Special Government Pleader appearing for the respondents 1 to 6 strongly objected the said contention by referring Rule 5 of the Secondary School Leaving Certificate Scheme. Therefore, the 3/7

learned counsel prays to dismiss the writ petition.

4. I have given my anxious consideration to either side submissions and also perused the materials available on record.

The issue involved in the present writ petition is no longer res integra as the order passed by this Court in W.P.No.18592 of 2025 dated 19.06.2025 has already held that the respondents have got competency to correct the date of birth subject to the proof and authenticity of the Birth Certificate. Therefore, without going into the merits of this writ petition, this Court deems it appropriate to direct the second respondent to pass order upon the petitioner's representation dated 23.07.2025, according to its own merits and in accordance with law, by taking consideration of the ratio laid down by this Court in W.P.No.18592 of 2025 dated 19.06.2025 within a period of four (4) weeks from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition stands disposed of. No costs.
