C.M.P.No. 19830 of 2025 in C.M.A. SR.No. 3782 of 2025 T.V. THAMILSELVI, J.

Challenging the award passed in Na.Ka.No:37506/N4/2017 dated 05.11.2024, the petitioners preferred the above Civil Miscellaneous Appeal, however there is a delay of 187 days in representing the above CMA.SR.No.3782/2025. Hence, the present petition has been filed to condone the delay in representing the above appeal.

2. Mr.B.Jawahar, learned counsel for petitioners submitted that the above Civil Miscellaneous Appeal was returned for rectifying certain defects on 20.01.2024, however, the paper was misplaced with other bundles and it could not be traced immediately. Thereafter, after due search, it was traced out, however, there a delay of 187 days arose in representing the above appeal and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

Considering the facts and circumstances and on considering the reasons stated by the petitioners in the affidavit that the bundle was misplaced, to give one more opportunity to the petitioners, this court is inclined to allow this petition.
