ORDER

This petition has been filed to set aside the order in F.C.M.C.No.17 of 2015 dated 27.01.2016 passed by the Learned Family Court Judge at Dharmapuri and thereby allow the above Criminal Revision Petition.

2. The petitioner has filed a maintenance case in F.C.M.C.No.17 of 2015 against the respondent/her husband. The maintenance case after adjudication was dismissed on 27.01.2016 against which the petitioner/estranged wife had filed this petition.

3. No appearance on behalf of the petitioner.

4. The learned counsel for the respondent submitted that due to the ill advice the petitioner had filed a petition. She had taken adventitious step and later after dismissal of the maintenance case realized the mistake. Now both the petitioner and the respondent are living together under one roof as husband and wife. The petitioner is aged about 66 years and her husband is aged about 77 years and further submits that there is no other matrimonial proceedings or connected proceedings pending against the petitioner and they are living as husband and wife happily.
