C.M.P.No.20542 of 2022 in S.A.(SR)No.110531 of 2021 C.V.KARTHIKEYAN , J., The Civil Miscellaneous Petition has been filed seeking to condone the delay of 238 days in representing the papers.
2. In the affidavit filed, in support of the said petition, it had been stated that the papers were presented on 06.12.2021 and were returned by the Registry on 09.12.2021. It was further stated that the Judgment and Decree in O.S.No.128 of 2009 was not available and therefore, certified copy could not be immediately obtained, there was a delay in representation.
3. In view of the reasons stated, the delay is condoned.
4. The Civil Miscellaneous Petition stands allowed.
